Shaw Files Infringement Suit Over 'Epic'

Atlanta, GA, Aug. 28, 2014 -- Shaw Industries is suing Carlisle Wide Plank Floors for trademark infringement and deceptive trade practices, the Atlanta Journal-Constitution reported.

The lawsuit stems from Carlisle's use of the word "epic."

In a lawsuit filed in Atlanta in federal court, Shaw claims Carlisle Wide Plank Floors refuses to drop the word “epic” from its marketing.

Epic engineered hardwood is one of Shaw's most popular hardwood flooring products and Shaw said it has had exclusive rights to use the word since 2006.

Carlisle markets itself “the epic wide plank floor company,” saying that it makes the widest, longest center-cut plank floors available in the world and that its product is “truly epic.”

Shaw is seeking unspecified damages and any profits Carlisle has made during the period of the infringement.

Shaw said it licenses the use of “EPIC” from Omaha-based Columbia Insurance Co., which owns the mark. Both companies are part of Berkshire Hathaway .
